It is driving me crazy that our elected officials don’t understand how our justice system works. Re: the infamous firefighter case, of course. Sotomayor’s court wrote what, a two-line brief, upholding the decision of the lower court? Deciding that the firefighters case had to either go back to the lower court or take a different route, that the district court had o grounds to overturn it. She did NOT decide that case. Grr.
Also, now that the case has been overturned by the Supreme Court, it was overturned 5-4. So even if she HAD ruled on that case, she would be in agreement with 4 of the nine current Justices. What better recommendation than that?
